so the answer to this (for now) is in settings under 'friends and chat' there is an option to turn off auto sign in at start up. turning that off prevents the issue.
or

pressing up on the stick or dpad once you load in appears to reset the menu

problem is UI u responsive on reboot or movement into game mode. appears to be accessing friend or other menus while showing home screen. happens every reboot.
